Terms of use
1. Welcome to Kemster
Kemster is operated by Deluxe Technologies FZC, based in United Arab Emirates ("Kemster", "we", "us"). These terms govern our website, mobile applications, agents and APIs. By using Kemster, you agree to these terms and our posting rules. Our Privacy Notice explains how we handle personal information. If you do not agree, do not use the service.
Kemster connects people posting what they have (listings) with people posting what they want (wants). We are not the buyer, seller, auctioneer, payment intermediary or escrow provider for deals between members, and we are not a party to those deals. Business sellers remain responsible for the consumer rights that apply to their sales.
2. Eligibility, accounts and verification
You must be at least 18 and legally able to enter into a binding agreement. If you act for a business, you must have authority to bind it. Do not use Kemster where doing so would violate applicable law or sanctions.
Provide accurate account information and keep it up to date. Protect your sign-in credentials and tell us promptly if your account is compromised. You are responsible for activity you authorize, including activity by employees, feed providers and agents. Do not impersonate another person, share an account to evade limits, or create accounts to bypass a restriction.
Checks can include email verification through our sign-in provider, phone verification through Twilio, and government-ID and selfie checks through Stripe Identity. Phone channels and verification requirements depend on availability, country, category and the feature used. Additional checks may be required for contact requests, shipping or higher-value listings. Verification badges and trust levels describe checks or activity; they do not guarantee identity, honesty, ownership, solvency or a safe transaction.
3. Listings, wants and matches
Post only lawful offers you have authority to fulfil and genuine wants. Describe price, currency, condition, defects, location and delivery accurately. Keep availability current and close posts that are no longer relevant. Sellers must meet applicable product-safety, licensing, tax, import, export and consumer-information obligations.
Follow the posting rules and prohibited-items policy, including restrictions on stolen or counterfeit goods, dangerous or regulated items, scams, exploitation and unlawful content. Do not spam, mislead, infringe rights, manipulate reviews, scrape personal information, send malware or bypass security, payment or usage controls. Use approved feeds and APIs rather than unauthorized automated access.
Matches, rankings, suggestions and alerts are discovery tools, not endorsements or promises of a sale, price, availability or response. Posts can expire and may need renewal. Private wants, broader reach and other features are subject to availability, settings and plan limits; a private want is not a promise that nobody else will see information shared in an authorized contact or agent interaction.
4. Messaging, payment and meetups
Treat others respectfully. Do not harass, discriminate, threaten or seek unnecessary personal information. Use contact requests, messaging, reporting and blocking tools responsibly. Messages may be processed to deliver the service and investigate safety reports; do not assume they are end-to-end encrypted.
Before agreeing a deal, check the item and the other party, and agree the total price, payment, delivery, customs, returns and any warranty directly. Meet in a busy public place, tell someone your plans and never share passwords or verification codes. A suggested meetup location is not a guarantee of safety. Read our safety guidance. In an emergency, contact local emergency services.
Kemster does not collect the purchase price of member-to-member deals, guarantee payment or provide buyer protection or insurance for them. Resolve transaction disputes with the other party or the relevant payment provider, and report suspected wrongdoing to us.
5. Fees, subscriptions and optional purchases
Free access has usage limits. Where enabled, paid products include Pro, Want+, Business, contact-credit packs, listing-specific Sell Faster passes and trust add-ons. See Pricing and the checkout offer for the available benefits, billing interval, price, currency and applicable charges. Availability and prices can vary by country and category. We do not charge a commission on a deal agreed between members.
Stripe processes Kemster purchases. Monthly or annual subscriptions recur at the interval shown at checkout until cancelled. Manage billing and cancellation through the Stripe billing portal linked from Billing; review its confirmation for the effective date and remaining access. Closing the checkout window or uninstalling the app does not cancel a subscription. Failed payments can affect access.
One-time packs, passes and add-ons do not themselves renew a subscription. Credits are consumed as described in the offer; a pass applies to its specified listing for its purchased duration. Trust add-ons may require evidence, review or a separate provider's service and terms; paying does not guarantee a positive verification result, an endorsement or a sale.
New offers do not automatically reprice an existing Stripe subscription. An existing subscription continues on its Stripe price unless changed through billing or a separately notified change. Running passes keep their recorded end dates when the default pass duration changes. Limits for new posts or reactivations can change without automatically taking existing active posts down; grandfathering is not a promise of permanently unchanged benefits.
Cancelling future renewals does not automatically refund an earlier payment. Except where the offer or applicable law provides otherwise, unused time, credits or unsuccessful attempts to sell do not entitle you to a refund. For duplicate charges, non-delivery of a paid feature, a billing error or a statutory cancellation request, contact us promptly with the payment reference, not card details. Duplicate trust-add-on payments are checked for refund; if an automatic refund cannot be completed, support must resolve it. Mandatory cooling-off, refund and consumer remedies remain available, including any rules on consent to immediate digital-service performance.
6. Dealers, partner feeds and external services
Dealers must have the rights and permissions needed to supply their feed, including images and personal information, keep inventory and prices accurate, and remove unavailable or unlawful offers. You remain responsible for imports you authorize and for complying with agreed feed limits. We may reject, pause or remove a feed or its listings.
Partner inventory and store-search links may direct you to third-party websites. Those providers control their own stock, prices, checkout and terms; confirm details there. Some outbound links may be affiliate links. A link or match does not make Kemster the seller or imply an endorsement.
7. Agents, AI providers and API keys
Use agents and APIs only within the permissions, scopes, limits and approval settings you authorize. Review generated descriptions, messages and proposed actions: AI can make mistakes. You are responsible for lawful instructions and for the actions you approve or delegate, including any offer or commitment made on your behalf.
Keep Kemster API keys and connected AI-provider credentials private, use limited permissions and revoke access you no longer trust. When connecting your own AI provider, you are responsible for its account, fees, terms, data practices and your authority to send information to it. Provider charges are separate from Kemster charges. Do not use agents to evade moderation, harvest member data, send spam or misrepresent who is communicating. Availability of an agent does not guarantee execution, accuracy or a particular outcome.
8. Your content and intellectual property
You retain ownership of content you submit. You grant Kemster a non-exclusive, worldwide, royalty-free licence to host, store, copy, format, translate, display and distribute that content as needed to operate, promote and improve the marketplace, subject to your visibility choices and our Privacy Notice. We may sublicense those uses to service providers working for us. This does not authorize publishing private messages as advertising. The licence ends when content is deleted, except for copies reasonably needed for legal, security or dispute purposes and copies already shared with other members.
You confirm that you have the rights and permissions needed for your content. Kemster's software, branding and original materials belong to us or our licensors; these terms do not transfer those rights.
To report copyright, trademark or other rights infringement, use Contact. Identify the protected work or right, the allegedly infringing material and its exact Kemster URL or identifier; provide your name, contact details and authority to act, a good-faith statement that the use is unauthorized, a statement that your information is accurate (under penalty of perjury where applicable), and your physical or electronic signature. We may remove or restrict material, seek clarification and notify its author. If you believe a removal was mistaken, send a counter-notice with the material's identifier, your explanation, contact details and signature; we will explain any additional requirements under the applicable notice-and-takedown law. Do not submit knowingly false notices. Repeat infringement may lead to suspension.
9. Moderation, restrictions and appeals
We use automated checks and human review to investigate reports, enforce these terms, prevent fraud and comply with law. We may reject or remove content, reduce its visibility or matching eligibility, restrict messaging or posting, suspend access, or close accounts. Some restrictions can leave content visible to its author but not to other members ("shadow restrictions"). We may withhold details temporarily where disclosure would enable abuse, compromise an investigation or breach law.
Where appropriate and legally required, we will give reasons and an opportunity to challenge a decision. To appeal, contact us with the affected account or content identifier, the decision and why you think it is incorrect. We will review relevant information and correct errors. You may also use any statutory complaint or dispute mechanism available to you. Do not evade a restriction by using another account or agent.
10. Availability and disclaimers
We aim to provide a useful, reliable service, but features can change, be disabled or be unavailable in some locations. To the extent permitted by law, Kemster is provided "as is" and "as available", without warranties of uninterrupted operation, accuracy, fitness for a particular purpose or the conduct of other members. We do not inspect every item or verify every claim. Nothing here excludes a guarantee or duty that cannot lawfully be excluded.
11. Liability and indemnity
To the extent permitted by law, we are not liable for losses arising from member-to-member transactions, third-party services, or indirect or consequential loss, lost profits, business opportunities or data. Our aggregate liability arising from the service in any twelve-month period is limited to the greater of the fees you paid Kemster in that period and AED 500.
These limits do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or any liability or consumer remedy that cannot legally be limited. Your statutory rights take priority.
To the extent permitted by law, you agree to reimburse us for reasonable losses, costs and third-party claims caused by your unlawful content, infringement of another person's rights, or material breach of these terms. This does not cover our own fault, override consumer protections or prevent you from contesting a claim. We will notify you of relevant claims and allow reasonable cooperation in their defence.
12. Governing law and disputes
The laws of United Arab Emirates apply, and the competent courts at Deluxe Technologies FZC's registered seat in United Arab Emirates have jurisdiction, subject to mandatory law. If you are a consumer, this does not deprive you of protections under the mandatory law of your habitual residence or your right to bring proceedings in a court available to you under that law. There is no compulsory arbitration or waiver of mandatory consumer rights in these terms.
Please contact us first so we can try to resolve a concern; doing so does not prevent you from seeking urgent relief or using a statutory remedy. Disputes about a member's sale remain between the transaction parties.
13. Changes and contact
We may update these terms as the service or law changes. We will publish the revised date and give reasonable notice of material changes before they take effect, except where an urgent legal or security reason requires otherwise. Changes do not remove rights already accrued. If you do not accept a change, stop using the affected service and cancel future renewals where applicable.
